Welcome to Regressio (“we,” “our,” “us”). These Terms of Service (“Terms”) govern your access to and use of the software-as-a-service application and platform (the “Service”) provided by Regressio. By accessing or using our Service, you (“User,” “you,” or “your”) agree to comply with these Terms. If you do not agree to these Terms, you should not use the Service.
1. Acceptance of Terms
By registering for, accessing, or using Regressio, you acknowledge that you have read, understood, and agree to be bound by these Terms. We may update these Terms from time to time, and the most current version will be posted on our website or within the application. Continued use of the Service after such updates constitutes your acceptance of the revised Terms.
2. User Eligibility
To use the Service, you must:
- Create an account with Regressio.
- Be capable of entering into a legally binding agreement.
By using the Service, you represent and warrant that you meet these eligibility requirements.
3. Account Registration
To access and use certain features of the Service, you must create an account. You will be required to provide accurate, complete, and up-to-date information during the registration process. You are responsible for keeping your account credentials confidential and for all activities under your account.
You must immediately notify us of any unauthorized use or security breaches related to your account.
4. Plans, Pricing, and Free Trials
Regressio offers both free and paid subscription plans. Details of each plan, including features, limits, and pricing, are available on our website or within the application.
- Free Plan: The free plan provides limited access to certain features of the Service, with specific limitations (e.g., storage, functionality) as outlined on the website.
- Paid Plans: Paid plans provide additional features, functionality, and support, subject to the plan you select.
5. Payment and Refunds
- Payment Processing: All payments are processed through Stripe, our third-party payment processor. By providing your payment details, you authorize us to charge your account for the selected plan and any applicable taxes or fees.
- Refunds: We offer prorated refunds for any unused portion of your paid plan if you cancel your subscription before the end of the billing cycle. Refunds will be processed in accordance with our refund policy and Stripe’s terms.
- Cancellation: You can cancel your subscription plan at any time through your account portal. Upon cancellation, you will not be charged for subsequent billing cycles, but you will retain access to the Service until the end of your current billing period.
6. Data Privacy and Security
We take the privacy and security of your data seriously. By using the Service, you agree to our Privacy Policy, which outlines how we collect, use, and protect your personal data.
We use third-party services such as Mailgun to send email communications and Stripe to process payments. These third parties are subject to their own privacy policies and terms of service.
You retain ownership of your data, and we only use it to provide and improve the Service. You may request access to, correction of, or deletion of your account and data by contacting us directly. Upon account deletion, all data associated with your account will be permanently removed from our systems.
7. Service Availability and Limitations
We strive to ensure that the Service is available with minimal interruptions. However, we do not guarantee continuous, error-free, or secure access to the Service. Maintenance, downtime, and outages may occur.
- Service Uptime: We aim for 99.9% uptime, excluding scheduled maintenance.
- Maintenance: We may perform maintenance, which could temporarily affect Service availability. We will make reasonable efforts to notify users in advance, but we cannot guarantee prior notice.
8. Limitations of Liability and Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind. We make no representations regarding the accuracy, reliability, or completeness of the Service, and we expressly disclaim all implied warranties, including warranties of merchantability or fitness for a particular purpose.
To the fullest extent permitted by applicable law, Regressio shall not be liable for any indirect, incidental, special, or consequential damages arising from or in connection with your use of the Service.
Your sole remedy for dissatisfaction with the Service is to stop using it.
9. Termination, Suspension, and Account Deletion
We reserve the right to suspend or terminate your account if we determine that you are engaging in fraudulent activities or unfair use of the Service. These activities include, but are not limited to:
- Using the Service for illegal or harmful purposes.
- Violating these Terms.
- Attempting to circumvent or abuse our billing system or Service features.
Account Cancellation and Deletion: You can cancel your subscription plan at any time through your account portal. If you wish to delete your account entirely, you can submit a request to our support team. Upon account deletion, all data associated with your account will be permanently removed from our systems.
10. Indemnity
You agree to indemnify, defend, and hold harmless Regressio, its affiliates, employees, agents, and contractors from any claims, damages, liabilities, or expenses (including reasonable attorneys’ fees) arising from:
- Your use of the Service.
- Any violation of these Terms.
- Any third-party claim arising from your actions or content.
11. Governing Law and Dispute Resolution
These Terms will be governed by and construed in accordance with the laws of the state of Ohio, United States, without regard to its conflict of law principles.
Any disputes arising out of or in connection with these Terms will be resolved through binding arbitration in Ohio. The arbitration will be conducted under the rules of the American Arbitration Association (AAA). The decision of the arbitrator will be final and binding.
12. Changes to These Terms
We reserve the right to update or modify these Terms at any time. Any changes will be posted on our website or within the Service, and the “Last Updated” date will be updated accordingly. Continued use of the Service after such changes constitutes your acceptance of the revised Terms.
